Information regarding the handling of your personal data

Here we compiled all information regarding the handling of your personal data by us, PFAFF Industriesysteme und Maschinen GmbH, as well as your rights resulting from data protection.

3. We need your data for these purposes:
 
We use your personal data to fulfill pre-contractual, contractual and post-contractual as well as legal obligations (art. 6 para. 1 b, c GDPR)
 
We use your personal data solely to fulfill and handle our business relationship with you. This includes for example

  • The process of inquiry/offer to the order to the delivery of the goods
  • Processing return shipments
  • Processing payments
  • Updating and maintaining your customer account and your customer master data
  • To process inquiries received via our internet contact forms
  • Within the framework of our legal obligations resulting from a purchasing agreement e. g. warranties or statutory warranty obligations
  • Within the framework of tax responsibilities

 
We use your personal data to protect our legitimate interests or those of a third party (art. 6 para. 1 f GDPR)

We process your personal data even when we or a third party have a legitimate interest in it: e. g. we can obtain credit information or have debts collected to guard against credit risks. As part of a business contact we process the contact data of the points of contact of our business partners. We also use personal data as part of direct advertising unless you object to it.

We use your personal data, if you agree (art. 6 para. 1 a GDPR)
 
In isolated cases we need your specific approval to process your personal data. In such cases we ask for your approval beforehand and inform you separately.
 
4. Your obligation to provide personal information
 
If we are supposed to do something for you (e. g. as part of an agreement), we will only do so, if you provide us with all required personal data. If you do not want to supply the data, we will not be able to act. In some cases there is also a legal obligation to provide us with your personal data.
 
We obtain personal data from these sources.
 
We process the personal data we receive from you. Additionally, if this is permitted, we process personal data which we obtain from public sources (e. g. record of debtors (creditworthiness data)) or other sources (e. g. credit bureaus (creditworthiness data)). Upon request we would be happy to provide you with more information.
 
6. Your rights
 
According to art. 15 GDPR in conjunction with § 34 Federal Data Protection Act (BDSG) you have at any time and at no cost to you the right to obtain information regarding your personal data that we have stored.
 
If you inform us that personal data are incorrect, we are required to correct these personal data. According to art. 16 GDPR you have a right to a correction.
 
Furthermore you have a right to have your personal data deleted, if you have good cause based on art. 17 GDPR in conjunction with § 35 Federal Data Protection Act (BDSG) e. g. if the data are no longer needed for the pursued purpose.
 
In rare cases (e. g. if it is not clear whether the personal data are correct or incorrect or if we would like to delete your personal data, but you do not want this) you may request the limited processing of your personal data. For this, the requirements stipulated in art. 18 GDPR must be fulfilled.
 
You can withdraw your agreement to the processing of your personal data at any time with effect for the future (art. 21 GDPR).
If for example you do not wish to receive any direct mail from us, you may object at any time and we will no longer use your personal data for direct mail.
If you object to the processing of your personal data, the lawfulness of the handling based on your earlier agreement until the objection will not be affected.
 
According to art. 20 GDPR you have a right to data portability. Among other things this means that you may be able to initiate a transmission of the personal data from one responsible party to another responsible party as long as this is technically possible.
 
If you have questions regarding the collection, processing or use of your personal data, for information or to inspect the data as well as to make suggestions, corrections, block or delete data and to recant approvals, please contact the data protection officer at PFAFF Industriesysteme und Maschinen GmbH (please refer to item 2).
You also have the right to complain to a regulatory authority.
 
7. Recipients to whom we forward your personal data

Within PFAFF Industriesysteme und Maschinen GmbH we use your personal data to fulfill our contractual or legal obligations.
 
To optimally process your order we forward your personal data to our service providers who we need to process the contractual relationship. Examples are shipping providers and financial institutions commissioned by us. If necessary and permitted or legally required, we forward your personal data to third parties or to processors. Processors process personal data on our behalf and solely as specified by us. Third parties or processors are for example IT-companies (e. g. to operate our website), credit agencies (to check the creditworthiness) or collection agencies.

8. We store your data for as little time as possible.
 
We store your personal data as long as we need them to fulfill our contractual duties or our legal obligations. Your personal data will be deleted as soon as we do not need them anymore and no law requires continued storage from us. Your personal data will not be deleted, as long as they are required to assert, exercise or defend legal rights.
 
9. Transfer to a third country
 
Based on our legitimate interest (art. 6 para. 1 f GDPR) and as part of a business we transmit the contact information of the points-of-contact of our business customers to our holding, the ShangGong Group Co., Ltd. in Shanghai. The transmission is carried out in accordance with the EU standard contractual clauses (http://eur-lex.europa.eu/legal-content/DE/TXT/HTML/?uri=CELEX:32004D0915).
 
10. We do not engage in data processing that is based on an automated decision. We do not engage in profiling (the automated processing with the objective to evaluate certain personal aspects).
 
11. Informational use of our website
 
Any time you access our website your webbrowser transmits user data to our server which are then stored in logfiles. The user data contain the following information:

  • IP-address of your terminal device (IPv4);
  • Date and time of the retrieval;
  • Path to the retrieved content;
  • Information regarding the operating system, the browser type and the browser version;
  • Transferred data volume;
  • Message whether the retrieval was successful.

 
We require these data for a safe and stable connection between you and our server
(art. 6 para. 1 lit. f DS-GVO). Immediately after calling up a website the IP-address is made anonymous by removing the last 8 bits.
 
12. Links to other websites (Third parties)
 
Existing links on our pages may direct you to websites of other companies. We are not responsible for the content and data protection strategies of those websites.
 
Privacy statement Google Maps
 
This website uses the product Google Maps by Google Inc. By using this website you agree to the recording, processing and use of the automatically obtained data by Google Inc, their representatives as well as third parties.

Youtube
 
Our web presence includes videos offered by (YouTube LLC, 901 Cherry Avenue, San Bruno, CA 94066, USA, represented by Google Inc. located at 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA).
If you play the video, a connection to a YouTube-server is established. That way information which of our web pages you visited is being transferred to YouTube.
If you are logged in to YouTube as a member while doing so, YouTube will assign this information to your personal user account. When using the service by clicking on the start-button of a video this information will also be assigned to your user account. You can prevent this assignment by logging out from your YouTube-user account as well as other accounts of YouTube LLC and Google Inc. and by deleting the corresponding cookies of those companies.
